GENERAL MISSION:




Reporting to the Recovery Department, the Head of Litigation Department is responsible for leading and managing all of the foundation's litigation actions, in relation to clients, ensuring the management of files classified as litigation and the handling of disputes with clients/Guarantors. They ensure the implementation of judicial or amicable procedures aimed at recovering debts while guaranteeing compliance with current regulations. They work in close collaboration with internal teams (Amicable, Pre-litigation, Write-off) and external parties (lawyers, bailiffs, courts).







MAIN RESPONSIBILITIES:





Litigation file management:






o Participate in the classification committee for litigation with the pre-litigation team to qualify unpaid files and validate the legal procedure to follow.
o From the classification of files for litigation, manage litigation files, whether judicial or negotiation for amicable settlement of litigation files, in relation to the parties concerned.
o Supervise the preparation of legal files and the organization of judicial actions in collaboration with law firms or the internal team of litigation officers.
o Coordinate actions with external service providers (bailiffs, lawyers, notaries, etc.).







Debt recovery:






o Develop and implement effective recovery strategies to reduce the rate of irrecoverable debts (framework, exploitation of guarantees and collateral, ...)
o Monitor recovery performance in litigation and identify areas for improvement.
o Ensure the implementation of amicable measures to maximize recovery chances before taking legal action.







Legal risk prevention:






o Analyze legal risks related to litigation and propose recommendations to mitigate them.
o Ensure compliance with procedures and regulations in force, particularly regarding client rights and regulatory compliance.
o Contribute to the continuous updating of contractual documents and internal procedures.







Management of partner relations:






o Collaborate with internal teams (Amicable, Write-off, Treasury,...) to ensure consistent handling of outstanding files.
o Monitor relations with external partners, particularly legal firms, to ensure the efficiency and speed of litigation procedures.
o Manage the invoicing of external recovery partners.







Reporting and monitoring:






o Establish dashboards for monitoring the evolution of the litigation file portfolio and recovery performance.
o Provide regular reports to management on the status of files, identified risks, and results obtained.
o Propose corrective actions and continuous improvements in the handling of litigation files.






Required profile :


EDUCATION:




Master's degree in business law, litigation law, banking law, or equivalent.

A specialization in risk management or financial law would be an added asset.







EXPERIENCE:




5 years of experience in a similar role, ideally in the financial, banking, or micro-finance sector.
Proven experience in managing complex litigation, particularly in debt recovery and judicial cases.
Experience in supervising legal or recovery teams.







SKILLS:





Technical skills:






• Solid knowledge of commercial law, contract law, banking law, and judicial procedures.
• Mastery of amicable and judicial recovery techniques.
• Good understanding of current regulations in the micro-finance sector and legal obligations related to litigation.
• Ability to prepare and manage litigation files while ensuring compliance with deadlines and legal procedures.
• Negotiation skills for amicable settlements.
• Good command of computer tools (Word, Excel, ...)

• Rigor, method, and organizational skills to manage multiple files simultaneously while respecting priorities.
