GENERAL MISSION:





Reporting to the Recovery Department, the Head of Litigation Department is responsible for managing and overseeing all of the foundation's litigation actions, in relation with clients, ensuring the management of accounts transferred to litigation and the handling of disputes with clients / Guarantors. They ensure the implementation of judicial or amicable procedures aimed at recovering debts while guaranteeing compliance with current regulations. They work in close collaboration with internal teams (Amicable, pre-litigation, write-off) and external stakeholders (lawyers, bailiffs, courts).







MAIN RESPONSIBILITIES:





Management of litigation files:







o Participate in the litigation transfer committee with the pre-litigation team to qualify unpaid accounts and validate the legal procedure to follow.

o As soon as accounts are transferred to litigation, manage litigation files, whether judicial or negotiation for amicable settlement of litigation cases, in relation with the parties concerned.

o Supervise the preparation of legal files and the organization of judicial actions in collaboration with law firms or the internal team of litigation officers.

o Coordinate actions with external service providers (bailiffs, lawyers, notaries, etc.).







Debt collection:







o Develop and implement effective collection strategies to reduce the rate of unrecoverable debts (structuring, exploitation of guarantees and securities, ...)

o Monitor collection performance in litigation and identify areas for improvement.

o Ensure the implementation of amicable measures to maximize recovery chances before undertaking legal actions.







Prevention of legal risks:







o Analyze legal risks related to litigation and propose recommendations to mitigate them.

o Ensure compliance with current procedures and regulations, particularly regarding customer rights and regulatory compliance.

o Contribute to the continuous updating of contractual documents and internal procedures.







Management of partner relationships:







o Collaborate with internal teams (Amicable, write-off, treasury,...) to ensure consistent handling of outstanding accounts.

o Monitor relationships with external partners, particularly legal firms, to ensure the efficiency and speed of litigation procedures.

o Manage billing for external collection partners.







Reporting and monitoring:







o Establish dashboards for monitoring the evolution of the litigation file portfolio and collection performance.

o Provide regular reports to management on the status of files, identified risks, and results achieved.

o Propose corrective actions and continuous improvements in the handling of litigation files.





Required profile :


EDUCATION:





Master's degree in Business Law, Litigation Law, Banking Law, or equivalent.

A specialization in risk management or financial law would be an additional asset.







EXPERIENCE:





5 years of experience in a similar role, ideally in the financial, banking, or microfinance sector.

Proven experience in managing complex litigation, particularly in debt collection and judicial cases.

Experience in supervising legal or collection teams.







SKILLS:





Technical Skills:







• Solid knowledge of commercial law, contract law, banking law, and judicial procedures.

• Mastery of amicable and judicial collection techniques.

• Good understanding of current regulations in the microfinance sector and legal obligations related to litigation.

• Ability to prepare and manage litigation files while ensuring compliance with legal deadlines and procedures.

• Negotiation skills for amicable settlements.

• Good command of computer tools (Word, Excel, ...)

• Leadership and ability to manage and motivate a team of litigation officers

• Rigor, method, and organizational skills to manage multiple files simultaneously while respecting priorities.

• Analytical and synthesis skills to quickly identify legal risks and propose appropriate solutions.

• Excellent communication and argumentation skills to negotiate with internal and external stakeholders.

• Stress resistance and ability to work in high-pressure or conflict situations.
